Architect/Engineer – Information for Professional Appointments
Mission: The focus of EOHLC’s mission for this appointment is to assist local housing authorities in the provision of state-assisted public housing for low-income residents in the Commonwealth of Massachusetts. MGL c.7C establishes the requirements for designer selection for the commonwealth. Said legislation establishes a Designer Selection Board (DSB) within the Department of Administration and Finance. The legislation also provides for EOHLC to be exempted from DSB’s jurisdiction by establishing EOHLC’s own Designer Selection Committee (DSC).
Size of the agency and the committee: The Bureau of Housing Development and Construction within EOHLC is comprised of approximately 50 professionals with varying backgrounds in design, construction and administration. The DSC is made up of nine members including three (3) registered architects, three (3) registered engineers, two (2) housing advocates and one (1) contractor.
Professional experience and background expected of the candidate: Under the provisions of the exemption, the candidate must be a Massachusetts registered Professional Engineer. Interest in affordable housing is desired.
Duration of the appointment: The appointment carries a term of two years with the ability of a second successive two-year term.
Frequency of meetings: One meeting per month, typically on the third Wednesday of each month at 1 pm for 2-3 hours. These meetings are held virtually
Actions typically undertaken at meetings: Review and discussion of the projects to be undertaken, review and discussion of the applicant design firms, establishing a ranked list of applicants for each project.
Average preparation time needed above and beyond meeting time: Varies from month to month depending upon the agenda. An average of 1 to 2 hours per month in addition to the meeting time can reasonably be expected.
Stipend, if any: No stipend for travel as meetings are held virtually as of several years ago. Committee members are designated as “special state employees.”
Non-professional considerations: The Professional Engineer must be licensed in Massachusetts and a legal resident of Massachusetts.
Special commitments (such as pro-neighborhoods commitment, commitment to historical preservation, to adaptive reuse, to mass transit, to linkage, etc.):
MGL c.7C was enacted to “ensure that the commonwealth receives the highest quality design services for all its public building projects; provide for increased confidence in the procedures followed in the procurement of design and design related services; promote consistency in the methods of the procurement of design and design related services for all public building projects in the commonwealth; foster effective broad-based participation in public work within the design professions; provide safeguards for the maintenance of the integrity of the system for procurement of designers’ services within the commonwealth;” The appointee should be committed to the above as it relates to designer selection for state-assisted public housing as well as being committed to promoting safe, decent and affordable housing opportunities.
Any constraints imposed on appointee’s professional practice:
In accordance with M.G.L. c. 7C, sec. 49(e), a DSC member shall recuse themselves from the designer selection process for a particular project if the DSC member or any member of the DSC member’s immediate family:
- has a direct or indirect financial interest in the award of the design contract to any applicant;
- is currently employed by, or is a consultant to or under contract to an applicant;
- is negotiating or has an agreement concerning future employment or contracting with an applicant; or
- has an ownership interest in, or is an officer or director of, any applicant.
In an effort to ensure the DSC maintains a quorum, priority in appointing DSC members will be given to candidates who, along with their firms, do not provide services on EOHLC funded public housing construction projects.
Any potential conflict of interest (such as appointee can’t be a city employee, can’t be contracted consultant to the city, etc.): The appointee cannot have any financial interest direct or indirect in any contract made by EOHLC.
