Federal Judge throws out Department of Labor and Department of Homeland Security H-1B visa rules issued in September. The Administration could choose to appeal the ruling. Although the incoming Biden Administration has different views on a variety of immigration policies such as DACA and asylum, there are some mixed signals on H-1B visas. President-elect Biden supports increasing the number of H-1B visas, which ACEC has advocated for years. There are also indications that the incoming Administration may support higher prevailing wages for H-1B visa holders. Description of Ruling
More ACEC Actions on PPP Loans: ACEC submitted a comment letter last week on the PPP large loan questionnaire. Here is the coalition letter ACEC signed to congressional leaders and Administration officials. Separately, a federal judge required the SBA to release additional information on all PPP loansis article; the data was made public on 12/2. Finally, ACEC is pushing Congress to include the PPP deductibility fix in legislation to fund federal agencies. The government is currently operating under a continuing resolution that expires on 12/11. Congressional appropriators are working on an omnibus bill. It's unclear whether Congress would agree to address this narrow issue on PPP without also agreeing to a new stimulus bill, but we'll hear more from ACEC national on this soon.
