Environmental Affairs Comm. Update on US EPA proposed RDA Permit

Frederick Civian, MassDEP's Stormwater Coordinator, spoke at the August 11, 2010 ACEC/MA Environmental Affairs Committtee.  Fred is responsible for reducing pollution carried by stormwater in Massachusetts. He had a key role in development and implementation of the 2008 revisions to the State Wetlands Program’s Stormwater Standards and works to harmonize and improve current and proposed federal, state and local stormwater rules.   He provided an update on the status of US EPA’s proposed Residual Designation Authority (RDA) permit for Bellingham, Milford and Franklin, how that proposal would affect private and public landowners in those 3 Towns, and the role that proposed permit would play in reducing pollution into the Charles River.

SUMMARY: The Clean Water Act (CWA) and related regulations define the specific industrial and municipal stormwater sources that must be authorized by an NPDES permit. The CWA recognizes that other sources, such as commercial properties, may need to be regulated on a case-by-case or category-by-category basis based on additional information or localized conditions. The authority to regulate other sources based on the localized adverse impact of stormwater on water quality through NPDES permits is commonly referred to as the "Residual Designation" authority. In 2008, EPA issued records of decision requiring additional NPDES stormwater permits in specific areas within the Charles River watershed in Massachusetts.
 
Recently EPA proposed a draft NPDES general permit for storm water discharges in the Charles River watershed within Milford, Bellingham, and Franklin, Massachusetts from certain private properties with two acres or more of impervious surface. This draft NPDES general permit establishes Notice of Intent (NOI) requirements, prohibitions, and storm water management practices for storm water discharges from designated discharge sites. UPCOMING PUBLIC INFORMATION SESSIONS
EPA is holding public information sessions about the RDA proposal. These meetings offer an opportunity for “constructive dialogue on the details of the draft permit.” EPA officials will offer a presentation, followed by Q&A. These are informational meeting to gather more details about the draft permit and to have your questions/concerns heard by the EPA.  Public comments  regarding the proposed RDA permit are due by September 30, 2010.

UPPER CHARLES RIVER OPTIMIZATION STUDY: In 2009, MassDEP, the US EPA and Tetra Tech Inc., along with local officials from the municipalities of Milford, Bellingham, and Franklin conducted a demonstration study in the Upper Charles River Basin to determine the optimal combination of structural best management practices (BMPs) to meet the phosphorus reduction targets of the Lower Charles River Total Maximum Daily Load (TMDL).

DRAFT MASSACHUSETTS NORTH COASTAL SMALL MS4 GENERAL PERMIT: EPA has proposed a new draft permit, known as the “North Coastal Small MS4 General Permit.” The draft permit would apply to 84 communities in eastern Massachusetts, in the watersheds of the Charles River, Neponset River and the Shawsheen River. The draft MS4 permit would require communities to continue to implement stormwater management programs already in place that are designed to reduce pollutants discharged from municipal storm systems to rivers, lakes and bays.
